Terms of Use

Acceptance of Terms

By downloading, installing, or using RoseFolio ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

Description of Service

RoseFolio is a mobile application for rose enthusiasts to photograph, identify, catalog, and share their roses with a community. The App includes AI-powered rose identification, garden tracking, a rose variety library, community voting, weekly photo competitions, and optional premium features available through a paid subscription.

User Accounts

  • You may use the App without an account for basic features such as garden tracking, the rose library, and Rose of the Day.
  • Sign in with Apple is required to participate in community features including posting, voting, competitions, and AI rose identification.
  • You are responsible for maintaining the security of your account and for all activity that occurs under it.
  • You must be at least 13 years of age to create an account and use community features.

Subscriptions and Payments

  • RoseFolio offers an optional auto-renewable annual subscription called "RoseFolio Pro" at $19.99 per year (USD) that unlocks premium features including increased AI identification limits (15 per day vs. 5 for free users) and the ability to enter weekly photo competitions.
  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
  • You can manage or cancel your subscription at any time by going to your device's Settings > [Your Name] > Subscriptions.
  • Subscriptions begin immediately upon purchase. No free trials are offered.
  • Prices may vary by region and are displayed in your local currency at the time of purchase. Price changes will be communicated in advance.
  • Refund requests are handled by Apple in accordance with their refund policies.

AI-Powered Features

  • The App offers AI-powered rose identification that analyzes photos you submit to suggest rose varieties and provide care information.
  • AI results are provided for informational and entertainment purposes only. They are not guaranteed to be accurate and should not be relied upon as professional botanical or horticultural advice.
  • Photos submitted for AI identification are processed by third-party AI services (OpenAI). By using this feature, you consent to this processing. Photos are processed in real-time and are not permanently stored by the AI service.
  • AI identification usage is subject to daily limits: 5 identifications per day for free users, 15 per day for RoseFolio Pro subscribers. Limits reset daily.

User Content

  • You retain ownership of any photos, text, or other content you submit through the App ("User Content").
  • By posting User Content to community features, you grant RoseFolio a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce that content within the App for the purpose of operating the service.
  • You represent that you own or have the necessary rights to any content you post, and that it does not infringe on the rights of any third party.
  • We reserve the right to remove any User Content that violates these terms or our community guidelines, at our sole discretion and without prior notice.

Community Guidelines

RoseFolio is a community for rose enthusiasts. To keep it safe and welcoming, you agree to the following:

  • Only post photos of roses and rose-related content relevant to the community
  • Do not post content that is illegal, harmful, threatening, abusive, hateful, sexually explicit, or otherwise objectionable
  • Do not harass, bully, or intimidate other users
  • Do not post spam, advertisements, or misleading content
  • Do not impersonate other users or misrepresent your identity
  • Report content or users that violate these guidelines using the in-app reporting tools

We may remove content and suspend or terminate accounts that violate these guidelines at our sole discretion and without prior notice.

Content Moderation and Reporting

  • RoseFolio provides in-app tools to report posts and block users. You can report any post by tapping the "..." menu on the post and selecting "Report Post."
  • You can block any user through the same menu. Blocked users will no longer appear in your feed and cannot interact with your content.
  • All reports are reviewed by our team. We will take appropriate action, which may include removing content, issuing warnings, or suspending accounts.
  • Reports are confidential — the reported user will not be informed of who submitted the report.
  • Abuse of the reporting system (e.g., filing false reports to harass another user) is itself a violation of these terms.

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to interfere with, compromise, or disrupt the App or its servers
  • Create multiple accounts to manipulate voting or competition results
  • Upload content that infringes on the intellectual property rights of others
  • Use automated systems, scripts, or bots to interact with the App
  • Reverse engineer, decompile, or disassemble any part of the App
  • Harass, abuse, or harm other users

Intellectual Property

The App, including its design, features, code, content, and branding, is owned by RoseFolio and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the App without prior written consent.

Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. AI identification results are not guaranteed to be accurate. Your use of the App is at your sole risk.

Limitation of Liability

To the maximum extent permitted by applicable law, RoseFolio and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or related to your use of or inability to use the App, including but not limited to reliance on AI identification results.

Termination

We may suspend or terminate your access to the App at any time, with or without notice, for violations of these terms or community guidelines. You may stop using the App and delete your account at any time. Upon termination, your right to use the App ceases immediately, but provisions of these terms that by their nature should survive (including disclaimers, limitations of liability, and intellectual property) will continue to apply.

Apple End User License Agreement

This App is licensed, not sold, to you. Your use of the App is also subject to the terms and conditions of Apple's Standard Licensed Application End User License Agreement (EULA). In the event of a conflict between these terms and Apple's EULA, Apple's EULA shall take precedence. Apple has no obligation to provide maintenance or support for the App.

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to its conflict of law provisions.

Changes to These Terms

We may update these Terms of Use from time to time. If we make material changes, we will notify you through the App or by updating the effective date at the top of this page. Continued use of the App after changes are posted constitutes acceptance of the revised terms.
